Profession Exemption

The AWR allows for an exclusion from the regulations for those contractors who are classed as working in a profession and where the client is a business operating within that profession.

The guidance is ambiguous but under the standard definition of a profession, we believe the following are criteria that demonstrate you to be working in a profession.  Where you can satisfy these criteria, you will be able to use the profession exclusion to remove yourself from the scope of AWR:

  • Hold professional qualifications or certifications in your field
  • Member of professional industry body (Chartered Institute etc)
  • Perform a role involving high levels of skill (i.e. average person could not perform your role)

AND:

  • Your client is in business within your industry/profession (e.g.  you are a mechanical engineer working for an engineering consultancy)

Documentation may be required to prove you hold the necessary professional qualifications.

How does it work?

If you exercise the Profession Exemption from AWR, the service will remain exactly as our traditional umbrella company service at present.

Fees

Our fee remains at £9.99 per week before tax relief for our umbrella company service under the profession exemption.
